4. Prohibition on Derivative Question Creation and AI-Related Misuse

This prohibition is grounded in copyright law principles protecting:

  • The structure, design, and composition of questions
  • The selection, arrangement, and pedagogical framework of the Content

Unauthorized reproduction or transformation of the Content through generative AI constitutes copyright infringement and unlawful exploitation of licensed intellectual property, regardless of whether the output is partially modified or paraphrased. Any such misuse, once detected, will be treated as unauthorized commercial use and will trigger the penalties described below.

5. Penalties for Unauthorized Use

Unauthorized use of the Content constitutes a material breach of these Terms of Use and may also constitute copyright infringement under applicable law.

In the event of unauthorized use, the user agrees to pay:

  • Content usage fees, and
  • Liquidated damages and contractual penalties,
  • With a minimum charge of USD 10,000 per violation, regardless of the scale or duration of the use

This amount reflects the commercial value of the licensed Content, the standard licensing fees applicable to institutional and professional users, and the administrative and legal costs associated with enforcement. The user acknowledges that this amount is reasonable, legally justified, and proportionate.

6. Basic Paid Service and Personal-Use Exemption

This website operates on a paid-license basis by default. The standard cost to use the Content is USD 10,000 upon commencement of use.

However, a special exemption is granted exclusively to individual learners.

  • "Individual learner" refers solely to the person who is personally studying the Content for their own learning purposes.

The exemption is a special privilege, not a right. The service is not fundamentally free; it is fundamentally paid, with a narrowly defined personal-use exception.

7. Institutional and Professional Use
